This is a contract for the sale of a Pet quality purebred AKC Havanese. This document concerns a live animal and is executed with prejudice in favor of that animal’s well being by those signing. This is a contract only and shall not be used for, nor constructed to be an application for registration of that animal or the get of any animal named herein.

This contract applies to the original puppy and the original buyer only and is non transferable to a second party. No replacement puppy will be given if this puppy has been bred outside the limitations of this contract or if the terms of the contract have otherwise been breached.

BUYER'S REPRESENTATION

The buyer agrees that he/she is not acting as or in part of, any agent in the purchase of this puppy and that the buyer will not sell the puppy or any of its progeny to any agent, animal broker or pet store. Buyer warrants that puppy will remain in his/her sole custody. This agreement is made between Laura Vivolo (breeder/seller)

TERMS AND CONDITIONS

The buyer is subject to all terms and conditions set forth below and as follows: The Buyer agrees to assume full responsibility for the dog once it leaves the premises. The buyer further agrees to provide a warm and safe environment. Provide food and water and seek a veterinary report, to retain possession and thereafter hold the breeder blameless and not liable for any further medical condition of the animal.

If Not satisfied the animal is to be returned to the breeder within 2 days from the exam, At the BUYERS expense, Consideration will be taken of the puppy if having to be shipped home. Do to flight arrangement and health of said pup. The buyer also agrees that in the event of the death in those 48 hours puppy will be taken to a vet for an autopsy that both buyer and seller agrees upon. If death is proven to be due to genetic illness or and illness contracted while in the sellers care, puppy will be replaced and autopsy expense refunded. This pup comes with a LIFE TIME GENETIC HEALTH GUARANTEE. If the pup dies of a genetic health problem Example Liver, Kidneys heart. And you have written proof from a licence veterinarian and you have notified the seller/breeder with in 48 hours of a pups passing. The dog will be replaced as soon as a replacement puppy is available by breeder. All above claims will only be honored with written documentation from a licensed veterinarian. The breeder has taken every reasonable precaution to ensure the physical soundness and temperament of the animal. Including its sire and dam are free of hereditary defect as far as known.

The buyer also agrees that the pup will have regular schedule visits with a Veterinarian, Under the veterinarian scheduled recommendation. as far as but not limited to Shots, worming, heart worming, teeth cleaning, over all physical health of pup. And records should be available to the seller if need be. Remember an overweight pup can lead to leg problem, jumping off of couches, beds or even being accidentally dropped can lead to injuries.

IMPORTANT NOTE

I do not guarantee any health related issues of loss of life due to a reactions caused by vaccinations or flea and tick preparations administered either orally or on the skin surface. I do not give Leptospirosis or corona to my puppies, Havanese can be sensitive to these shots and you should seek advice from you veterinarian before giving this shot. As a breeder/seller I have done everything possible to assure the eye lines of the above dogs are safe from defects. I cannot be held responsible if something does develop in the above dogs eye.

The puppy is being sold as a pet only and the buyer agrees to spay or neuter puppy by 6 Months of age. Unless a veterinarian says otherwise. Remember neutering you male before 6 mo. Of age will help him keep from learning to lift his leg and marking. A copy of the spay or neuter certificate should be sent to the breeder showing the pup was altered by 6 mo. or your LIFETIME health guarantee can and will be voided.

The breeder shall provide AKC papers marked LIMITED with each pet puppy. Any offspring from this dog will never be able to be registered with AKC. If for some reason I have not received the litter registration papers from AKC at the time puppy is delivered to the buyer I will send them out to the buyer as soon as I receive them.

PURCHASE INFORMATION

PLEASE MAKE DEPOSIT CHECK PAYABLE TO LAURA VIVOLO

In consideration of the fee of $___________dollars. A deposit of $___________ in advance and the remainder of $______________to be paid by CASH OR CASHIERS CHECK. Before puppy leaves breeder/seller. (DOES NOT INCLUDE SHIPPING CHARGES.) The deposit is NONREFUNDABLE.

Buyer is responsible for the cost of transporting puppy. All transportation costs shall be paid in full prior to shipment of the puppy. Seller will be responsible for the crate, health certificate and getting the pup to the airport.

In the event a deposit was made but there is not a puppy available due to an unforeseen circumstance. The deposit will be refunded. If seller has not received balance due and shipping charges before the puppy is 10 weeks old, deposit will be forfeited and puppy will be sold to someone else, unless prior agreement was reached between buyer and seller. If for any reason after a deposit was received seller decides it is in the best interest of the puppy not to be placed with buyer, deposit will be refunded. Puppy does not become property of buyer until puppy leaves seller’s premises.

RELINQUISHMENT OF PUPPY

The buyer hereby agrees that if at any time the buyer cannot take proper care of the dog, the buyer must contact the breeder and the breeder will have first choice to either (a) take the dog back and /or (b) assist the buyer in finding a suitable home for the dog. Neither of these 2 options guarantees that the buyer will recover all or part of the purchase price.

JURISDICTION

This contract is to be construed in accordance with the laws of the State of Washington. If any legal action is to be taken by either Seller or Buyer, venue shall be in King County, Washington State. If any provision of this document is invalid or unenforceable under applicable law, this document shall be ineffective to the extent of such invalidity only and shall remain in full force and effect otherwise, without affecting the remaining provisions.

NO variations are accepted unless in writing and agreed upon and signed by both buyer and seller. **Please send the deposit and signed contract back as soon as possible. I would like it within 7 days of the date I signed, in order to hold the puppy.
